1. Introduction

Welcome to Odin Trading Platform ("Odin," "we," "us," or "our"), a property of Phoenix Technologies. These Terms of Service ("Terms") govern your access to and use of the Odin trading software, website, and services.

By accessing or using Odin, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use Odin.

2. Service Description

Odin is a browser-based trading platform designed for professional traders. The service provides advanced charting, depth of market (DOM), risk and lockout controls, and modular workspace features, among other capabilities described on our website.

Connectivity scope. Odin connects directly to six supported providers: Rithmic, dxFeed and TFeed for futures, and cTrader, MetaTrader 4 and MetaTrader 5 for CFD and Forex. Availability of any individual provider may be restricted by your jurisdiction or account type.

Copy trading. Cross-provider copy trading is supplied by Thor, a separate Phoenix Technologies service, and is made available through the Phoenix Bundle subscription. Thor's supported provider list is broader than Odin's direct connectivity and is described on the Thor website. Nothing in these Terms should be read as a representation that Odin connects directly to any provider not listed above.

3. Account Registration

To use Odin, you must connect through a supported data provider. You agree to provide accurate, current, and complete information and to maintain the security of your account credentials.

4. Payment and Subscription

Use of Odin may require payment of fees as described on our website or through your data provider. All payments are non-refundable unless otherwise specified. We reserve the right to change our pricing at any time.

5. User Responsibilities

You are responsible for all activity that occurs under your account. You agree not to:

  • Violate any applicable laws or regulations
  • Infringe the rights of others
  • Attempt to gain unauthorized access to Odin or its related systems
  • Transmit any viruses, malware, or other harmful code
  • Use Odin for any illegal purpose

6. Intellectual Property

Odin and its original content, features, and functionality are owned by Phoenix Technologies and are protected by international copyright, trademark, and other intellectual property laws.

Third-Party Marks. TradingView and Pine Script are trademarks of TradingView, Inc. NinjaTrader, MetaTrader, cTrader, Rithmic, dxFeed, Tradovate, DXtrade and all other third-party names, logos and marks referenced in the Service or on our websites are the property of their respective owners. Odin is an independent product of Phoenix Technologies and is not affiliated with, sponsored by, or endorsed by TradingView, Inc. or any other third party. References to third-party products, including statements of compatibility with the Pine Script language, identify interoperability only and do not imply any partnership, license or endorsement.

7. Termination

We may terminate or suspend your account and access to Odin immediately, without prior notice or liability, for any reason, including breach of these Terms.

8. Disclaimer of Warranties

ODIN IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

WE DO NOT WARRANT THAT ODIN WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF ODIN IS ACCESSED AT YOUR OWN DISCRETION AND RISK.

9. Limitation of Liability

IMPORTANT RISK AND LIABILITY DISCLAIMER

ODIN IS PROVIDED FOR TRADING PURPOSES AND PHOENIX TECHNOLOGIES ASSUMES ABSOLUTELY NO RESPONSIBILITY OR LIABILITY FOR ANY LOSSES INCURRED AS A RESULT OF USING OUR SOFTWARE.

BY USING ODIN, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

  • PHOENIX TECHNOLOGIES AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  • YOU BEAR SOLE RESPONSIBILITY FOR ANY DECISION MADE OR ACTION TAKEN BASED ON INFORMATION RECEIVED THROUGH ODIN.
  • PHOENIX TECHNOLOGIES IS NOT LIABLE FOR ANY LOSSES, DAMAGES, OR COSTS THAT MAY RESULT FROM ANY ERRORS, GLITCHES, TECHNICAL FAILURES, SERVER DOWNTIME, DELAYS, HARDWARE OR SOFTWARE MALFUNCTIONS, OR ANY OTHER TECHNICAL ISSUES WITHIN THE ODIN SYSTEM.
  • TRADING FUTURES INVOLVES SUBSTANTIAL RISK AND IS NOT SUITABLE FOR ALL INVESTORS. YOU SHOULD CAREFULLY CONSIDER YOUR FINANCIAL CIRCUMSTANCES BEFORE TRADING.
  • PAST PERFORMANCE IS NOT INDICATIVE OF FUTURE RESULTS, AND NO REPRESENTATION IS MADE THAT ANY ACCOUNT WILL OR IS LIKELY TO ACHIEVE PROFITS OR LOSSES SIMILAR TO THOSE SHOWN.
  • IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO PHOENIX TECHNOLOGIES FOR ACCESS TO ODIN DURING THE TWELVE (12) MONTH PERIOD PRIOR TO THE CLAIM.

BY CONTINUING TO USE ODIN, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THIS DISCLAIMER IN ITS ENTIRETY.

10. Indemnification

You agree to defend, indemnify, and hold harmless Phoenix Technologies, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of Odin.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of France, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.
